Shoplifting

my son was caught shoplifting by a store employee, as he was leaving the store the clerk ask to see what was under his shrit. He lifted his shirt and handed the merchandise to the clerk. He then said we need to go to the office. My son said no and left the store. The police have yet to file a report and nothing has come in the mail. Can he still be charged with shoplifting? I have been told that since he left the store without the merchandise and that the police did not have a chance to come to the store to take him into custody that nothing can be done.

He can still be charged with retail theft. The question is, do they know who he is, and can they establish his identity?
