Legal Question in Criminal Law in Pennsylvania

simple assault charges

My son was at someone's house with several other teenagers. A girl was continuously harrassing him and his friend. She threatened to do bodily harm to him, then proceded to text another male to jump my son (there are witnesses). My son and his friend decided to leave. The above mentioned girl proceded to follow them out of the house, stating she wanted to watch him ''get beat up'', and that she wanted to get in the last kick. Once outside, she grabbed my son's friend and took his ipod. While she was trying to leave, my son tripped and shoved her down. His friend retrieved his ipod and they left. The girl immediately got up and started chasing them for a few feet before she stopped. Now, my son is being charged with simple assault. She claimed he was banging her head on the ground, which turned out to not be true. She is also claiming that the ipod was given to her inside the house. Please be advised, while this incident did occur with a girl, she outweighed him by 40 to 70 pounds. What should my husband and I do?

Re: simple assault charges

Your son needs to retain counsel to defend against these charges. I don't know how old he is but he will either be prosecuted as a juvenile or as an adult. Feel free to call me directly to discuss. 267.639.3105.

Re: simple assault charges

Unfortunately, the only thing you can do is get a good defense attorney. Being charged IS NOT the same as being convicted (or accepting a plea bargain!)... everyone is innocent until proven guilty beyond a reasonable doubt.

Contact me with some more details, including the location of the alleged incident, your son's age and school, and I'll get back in touch.

Mike
