simple assault/harassment

my son was in a fight, hurt the kid, he went to the hospital. They said the charges filed would depend on how bad he was hurt. It would be harassment unless it was too bad. I think the kid ended up with a broken jaw. what should we expect in charges

With a broken jaw the proper charge is aggravated assault. It seems though that the police were going to file it as a harassment so that it wouldn't even rise to the level of a misdemeanor. They may go along with simple assault.

Assuming there are no defenses, it sounds to me as if a plea to simple assault would be a pretty good idea without talking to the police or the Asst. District Attorney or knowing the facts.

You should always hire an Attorney who practices criminal law in your own area to handle a matter like this.

depends...did your son use any type of weapon (anything other then his hands)? if so, he can face aggravated assault. he may still face those charges even if he used his bare hands if the facts can prove that he had the "intent to cause serious bodily injury." Call me if you want to discuss some more!
