Legal Question in Criminal Law in Pennsylvania

My son is being accused of something he didint do

my sons school is sccusing him of writting a bomb threat, they called the bristol township pollice they got involved and no charges were filed against him due to no proof. Now the school is trying to exspell him, with no proof he did this! This is dragging him down I want to sue the district and need help fighting them on this matter. When we told the superintendent we were going to get a attorney she laughed in our face..and actually dared us! Their attorney on my paper work is Mr.Russ Sacco. I want help on figuring what rights my 14yr old son has, and what right does this school have to put a terroristics treats/acts on my sons record that they have no proof of...someone please help me, Thank you--name removed--

I agree with the other answer. I have had two of these cases in the past. I feel as though the schools do this to get rid of a kid they don't want, then they try to put all of the kids they don't want at the same school and it is a disgrace. my view is that we pay taxes for these folks to educate our kids and some times some of the kids need a little more love than others. making up bomb threats is horrible. you definitely want to take a lawyer with you the whole want with only your child's best interest at heart and mouth to fight for him.

Your son has a right to a hearing before the school board (or their appointed hearing officer) if they want to expel him.

They have to prove that he did what he is accused of.

At that hearing, you should have an attorney, and you should have a transcript made of the hearing so that you can appeal any decision they may make to court.
