Legal Question in Criminal Law in Pennsylvania
My son is incarcerated he has plead guilty he got out on parole he got another charge dui the judge went back to the original charge 2yrs min-3 yrs max and made that 3 yrs min-5-max is that legal? I need help they are really giving my son the run around they charged him with 2 charges its on paper but at court they had more charges??? How also he is getting a psi and re-sentenced can they go back to the charges he has already completed or just the two he has left?

If he didn't go to jail then he was on probation. If you're on probation you may not drink alcohol. Getting a DUI is proof that he did drink. So he violated probation. So He is in line for additional punishment.
Can they doi this? Well apparently because they did.
