Legal Question in Criminal Law in Pennsylvania
My son is almost 5 months old I live with my fiance. We are great parents and take wonderful care of our son. Yet he had unexplained bruising, none of us have ever hurt him or anyone who has watched him. He had a red dot in his left eye and redness spread to the other eye. Then he had slight bruising under his eyes and it slowly progressed within over a week. He had more bruising then his eyes got very red under the pupil. I couldn't take my son to the er lack of gas they suggested to go to the ER. Automatically with assumption the doctor said abuse and called child services.. I would never hurt him I took him to the ER to get an explanation of whats wrong... they wouldn't do a blood test & they took xrays they came back great. I read plenty of reasons infants get bruising under the eyes but they automatically assumed abuse. Child services is investigating and so are the police. Children youth hasnt gave me a hard time yet besides putting my son with a trusted individual. The police are giving me a hard time unrightfully accusing me and my fiance and threatening they will take me & him to jail, if the blood results come back no medical evidence. The police also say I have to take a lie detector test advice please. I have nothing to hide this situation is getting out of hand.

I had a case where a child had numerous broken bones. The test to determine whether it was a medical condition was most costly the C& Y wanted to pay. The child was put in placement. When the child continued to get fractures C&Y had to admit it wasn't child abuse.
The brusing you mention could have a medical cause such as hemophilia.
You can prevail in a C&Y case. It will take time and effort.
