Legal Question in Criminal Law in Pennsylvania

Can my son who is 19 get a public defender for a misdemeaner drug charge preliminary hearing in Altoona, PA? He is in college there.

Maybe. To be entitled to a public defender he must be facing a minimum of 6 months in jail.

If he has no prior convictions he should look in to ARD. It allows him to avoid trial. He'll pay fines and costs and do community service. The best part is if he can get ARD then even the arrest record goes away.
