Legal Question in Criminal Law in Pennsylvania
Spouse, indictment, and divorce
My wife is under indictment in IL (I live in PA) and will more than likely plead guilty or take a plea deal. Due to the crime I plan to divorce her. Is there a better time to complete the divorce? If I finish the divorce before her trial will I have to testify? I have not been issued a subpoena and have no direct knowledge of the crime so have no information to share but do not want to be involved either. Her arrignment was on Monday and discovery has begun.

If you have no knowledge of the crime then why would either side call you as a witness.
If you wife will consent the divorce could take place in PA. Depending on the grounds the divorce could take as little as 4 months. It might be quick in IL.
