Legal Question in Criminal Law in Pennsylvania

my Ex and his SSI

when we were married he was appoved for SSI. Myself and our children recived as well. When we split apart and the children live with me I was taken off his SSI. Taht was in 2001. Now he was abusive and that is why I am not with him. I have RA and I am out of work. I went to the county for food stamps. They call me telling me I did not report my daughter SS she gets per month. I did not know about this money so that is why I did not report it as income. I told them of the abuse and how I can not call SS and look into this in fear of what would happen to me. So I was told they would look into this and get back to me. Taht was days ago. They told me I should have been getting those checks not him because they are my daughters check for her. Since she lives with me I should get them. Is this true? what is going to happen here? it has been since 2001 that he has been getting her check. will the county report this is SS?

Will he have to pay back all that money and then does it come to me? they tel me what he is was wrong.

Re: my Ex and his SSI

As an administrative matter, this is a family law issue and you may want to relist the question in that category so that you can receive more responses.

If you have a support and custody order stating that your child is primarily in your custody and that your ex is to pay support and he has failed to do so, then it sounds as if you have a claim.

Whatever paperwork you have needs to be reviewed by comptent counsel as soon as possible so that you know where you stand and what will serve your child's best interests.

I am assuming that by RA you are talking about a protection from abuse order and/or a restrainging order and therefore understand your need to proceed cautiously, especially if it is due to expire any time soon.

Feel free to call me to discuss this matter.
