Subpoena for Email records
How ''obtainable'' are email or instant message records from service providers like AOL and Yahoo? (Given a proper subpoena for the defense.) Do these firms keep email records even from accounts that have been closed? How long are they kept? And would such records be admissible in a trial to demonstrate false testimony by a complainant in a criminal trial? One hears often of public figures who are indicted/convicted on the basis of past emails. . . How are these records obtained?

They are around for a very long time. If someone whats to obtain them they are obtainable.
