Legal Question in Criminal Law in Pennsylvania
Suspended License
My driver's license was suspended for two reasons: not carrying liability insurance (3 mo. suspension) and driving on a suspended license (1 yr. suspension). This all occured on the same day.
Regarding the second offense, driving on a suspended license, I was going to appeal it because I have documentation that could have cleared that offense, and I was scheduled to appear in court. Due to emergency surgery, I was unable to appear. When I called to reschedule the hearing, the DA's office said that I didn't call soon enough. (requires call 24 hours in advance; I called the day of) I was then deemed guilty. This was about four months ago. I simply didn't have the money to pay the fees.
Last week, I contacted my state representative who said that PennDot said to be considered for an OLL, I must pay all fees, which I did. I then received a call from the state rep, who then informed me that PennDot said they would not grant me an OLL because of the lack of insurance offense. Do you think it's worth pursuing an appeal through civil court for the suspended license offense? This would reduce the time to 3 months instead of 15 months. My new job depends on this.

Re: Suspended License
It certainly WOULD have been worth appealing, but you had 30 days to do so. You are well beyond that time, and your appeal will likely be rejected because you didn't file it in time.
