Legal Question in Criminal Law in Pennsylvania

Theft

If you are accused of theft is it legal for your employer to search you personal property if he does not have a police officer present ? Also, if he takes money from you without your consent and gives you a receipt stating that he took the money for restitution of theft, is he saying he is allowing you to pay restitution ? Can he still press charges?

Store owners enjoy statutory immunity as to detentions and searches which may be applicable in your situation. The actual taking of money even providing you a receipt may be actionable. Why would you even think to allow them to take your property..ie...money? Did you steal from the store, if so what? Is there proof, if so what? If you didn't you would have an action against the store...you need to consult with an Attorney ASAP.
