The judge decides the amount of time. In PA, there are sentencing guidelines, but they are just that guidelines. The judge can give you whatever he or she wants to give you. Further, if you have never been arrested before, you probably will get probation or ard unless the amount of the retail theft or the paraphernalia is huge. Good Luck.
