Legal Question in Criminal Law in Pennsylvania
Too much time/unfair sentence
My brother was attacked by an Ex with a mammoth dog bone causing him to bleed. She continued to strike him constantly. In an effort to get her off of him, he threw her to the ground and kicked her 1-2 times striking her face. This blow resulted in an injury that knocked her eye out of its socket. The lawyer that was hired put no effort into the defense. My brother is a 2 time felon in Phila. and was not on parole, but the lawyer basically yielded to the guidance of the judge and procecution by forcing my brother to take a plea deal of 9 to 18 years. He told us that there was no way to beat the aggravated assault charge because of the extent of the injuries, even though she struck him first repeatedly. Question is: Is there any way that this charge could have been reduced to a lesser charge with less amount of time to be served? He is father of 3, and was on the right path until this incident. We are wondering if the outcome could have been different due to the full details of the case.

Re: Too much time/unfair sentence
It's unfortunate, but it's something I see every day in Court. Attorneys who do not want to, for whatever reason, actually take a case to trial.
Was this an appointed attorney (PD) or someone you hired? How long ago was the sentence....you only have a short time to retract the plea!
