Legal Question in Criminal Law in Pennsylvania
I was told by my public defender to waive my preliminary hearing and I would only be charged with a misdemeanor of hindering apprehension. I waived it, and spoke with the detective- he didn't "feel" I was cooperative enough and is sticking with it as a felony. Can I request to have my prelim hearing again before I take it to trial? Can I switch public defenders if she isn't doing anything?

And you spoke to the detective without your lawyer WHY? A criminal defendant should NEVER talk to the police. No you can't ask for a preliminary hearing. You're stuck with your decision. That said so is the DA. They can't change what you were charged with. Unless they want to start with another preliminary hearing.
