Legal Question in Criminal Law in Pennsylvania

Underage drinking citation or Probation = Jail?

I am 20 years old. i am on probation for a first offense DUI. I recently got a citation for being observed drinking one beer in a bar. the citation actually says that i only had one beer. I am terrified that I am gonna end up seeing jail time over this. Is that at all possible? Or will i just get community service or maybe an extended probation or just a fine. I don't care as long as i don't goto Jail. is there any chance i could goto jail over this? I'm freaked out badly. Please help me here.

Re: Underage drinking citation or Probation = Jail?

First and foremost, why were you in a bar if you were aware of your probation status, and secondly who is the alleged witness that actually saw this act? The bottom line here is, yes you may have violated the terms of your probation, however, this is all dependent upon the Commonwealth (DA and Police) proving their charges against you.

The bottom line here is that you should retain an attorney ASAP, do not under any circumstances plead guilty or accept a plea agreement to any violation without legal representation! Pleading guilty to a new charge may revoke the terms of your previous plea agreement and you may also be subjected to new and additional criminal charges for violating your probation.
