Underage Drinking in PA

I was at a party where people were drinking but was not myself being a driver for the night. When the cops arrived I requested a breathalyzer test and was told to wait by the side. The cop who told me to wait left the house and did not return. It was also stated by a cop at the party that he did not believe me to be drinking, and by the resident of the house that I was not,yet I was cited anyway. What chances do I have of this being thrown out?

The chances are very good that it will be thrown out if your case is presented properly, as they have no evidence. You should get an attorney.

It depends if the officer wrote down anything about alcohol smell, or a "confession" Because of the chance of losing your license you should get an attorney to present your best case or plea it down.
