Legal Question in Criminal Law in Pennsylvania
Underage drinking and pot smoking in Pennsylvania
What are the legal ramifications for being caught drinking and/or smoking pot as a minor is Pennsylvania to the minor and their family if the child is caught drinking not at their family's home? I'm assuming obtaining a driver's license will be in jeopardy? Also, what quantity of pot will get the minor in real legal troubles?

Re: Underage drinking and pot smoking in Pennsylvania
The real question is what are the legal ramifications. The answer is that it really depends on how the arrest took place and why the minor was arrested. Also, has the minor ever been arrested before? There are three possible charges for possession of pot in PA: possession with the intent to deliver, knowing and intentional possession, and possession of a small amount. The police and the DA decide how to proceed , but the circumstances of the arrest truly dictate the answer. If you want to know, "what will happen to the minor?" that depends much more on the kids prior contacts with the system, their school record, an evaluation of the kid, and how old is the kid.
