Legal Question in Criminal Law in Pennsylvania

victim of random assault battery

in butler pa i go to a pool hall often and a female had mistaken me from behind as the person that formerly assaulted her.

From behind while bending over playing pool this female named michelle kicked me in the groin full force.

After I fell everyone asked her why she did that. She said 'that's such and such name, he tried to rape me before.'' The people said ''that's not whatever name she said.''

now i have serious problems from that single kick. she mainly got one testicle full force..

six people in the pool hall know her by name, where she lives, and her phone number.

What charges can I press... assault, sexual assault, aggrivated assualt, torture, ... I'm not sure and can i sue for pain and suffering along with med bills. doctors said all will heal itself, not rupture, torsion, or anything.

what kind of settle, award can i win against her.

Re: victim of random assault battery

You may have a cause of action against both the assailant and also the pool hall for failure to provide adequate security. Feel free to call our offices to discuss and set up an appointment. No fee for consultation and no fee unless you recover.

Re: victim of random assault battery

From what you describe, the criminal charges could be aggravated assault and simple assault. These would have to be filed by the police...you should talk with the police in the area where this occurred.

With regard to a civil suit, you could sue her and possibly the owner of the establishment where this occurred for starters. Without seeing your medical records, and hearing more about this matter from you and the witnesses, it is unclear what you might recover.

If you wish to discuss this further, feel free to email me.
