Welfare Fraud???

My wife and I are getting food stamps along with medical assistance. 10 months ago I got a job and 8 months ago we received paperwork from office to fill out. My wife filled out all except the work part that I was supposed to fill out. I forgot to fill it out and mailed it out. Now I think we are being investigated for welfare fraud because I got a paper in the mail stating they searched my social security # and found I was working and that I didn't report it. What could the penalty be and is there anything we can do to resolve this because it was unintential. Thank you.

Whether or not you are prosecuted you will have to pay back any amount that you were overpaid. It is a good idea to contact the Office of the Public Defender in your County or to retain an attorney if you are able to afford one as soon as possible.

You are going to be prosecuted, in all likelihood. Neither the government, nor a jury, is likely to believe that your failure to fill out the form was unintentional, because your "mistake" resulted in double income. If you were receiving benefits, you definitely knew that something was wrong, and you accepted them. You should retain private counsel immediately.
