Legal Question in Criminal Law in Pennsylvania
If a wife is injured in a domestic disturbance and there are criminal charges against the husband by the State. Can the wife statement be retracted without legal remorse against either parties.
1 Answer from Attorneys
What the heck is legal remorse? If there is an injury the police witnessed they can testify and that might be enough to sustain a conviction.
In cases of domestic violence the victim often recants. That said the case will go forward. As many times such recantations are the result of witness intimidation or fear of the victim of loss of support.
Reading between the lines it looks like you're asking if I can beat the rap if you get your wife to recant. If that is the case shame on you, it's bad enough you abuse women it's worse if you victimize her again by asking her to recant.
