Legal Question in Criminal Law in Pennsylvania

I'm wondering if I should stop or if their is ground to keep going. My son is 10 yrs and was battered and bruised from a sub teacher at his school. The school documented the black and blues and scrapes the following day and fired the sub teacher. A investigating trooper came to my house about 2 weeks after the incident and interviewed me and my family. He just emailed me and informed me that the DA and him had a very long talk and the DA decided not to press charges and she got off.

1. Should I give up and let her get away with the assault.

2. Can I file a complaint myself will that make her have to go to court to answer?

I have had so many problems with the school this past year that I'm actually worried for the upcoming year to start.

Not sure if it is American disability laws, Civil Rights or just criminal law?

He is a child who has an IEP with a learning disability.
