Legal Question in Criminal Law in Pennsylvania
Wrong Paperwork
I was charged with an underage drinking and possesion of paraphenalia in PA. I just recieved my summons in the mail and on every sheet in the summons my name is wrong. The only proof that it is in fact me is my social security number, which appears on only 3 out of 13 pages. Does that give me any legal advantage?

Re: Wrong Paperwork
This gives you no legal advantage whatsoever. In no way will this help you. If you do not appear for the date and time listed on the summons a bench warrant for your arrest will issue. Further, some one, some where, some how, saw you in regard to this case. That person can identify you as the person they saw. That identification is the sole factor in determining your identity--name, finger print, social security number are not relevant.
However, if your defense in your case is mistaken identity, or that the person who got arrested stole your identity, then you may have a shot. But that is a long haul on a paraphenalia case.
