Legal Question in Discrimination Law in Pennsylvania

employment discrimination

hello, ive been at my job for 6 and a half yrs.for the 1st 5 yrs i was told i cannot apply for a promotion because it requires the use of a forklift.when i started i was trained on the forklift and passed the driving exam but then i failed the vision test so i am not allowed to drive the equipment.after 5 yrs im told that i may put in for some promotions because they have changed their requirements for some departments not having to drive the forklift.i am vision impaired in one eye.i was born this way and to me i cannot tell any difference to the contrast.i have driven equipment at other jobs without any problem or accidents.i recenlty applied for another promotion which i was told i was a good canidate but i cannot drive the forklift.my boss called headquarters and asked the guy in charge of safety about my situation and he said they cannot allow me on the forklift because if somethng flew in my good eye i would be left with no vision.do i have a case for discrimination?

Re: employment discrimination

You asked about discrimination.

You may have a claim and then again you may not have a claim.

The answers will depend on the specific circumstances, your specific diagnosis and the jobs that you perform and the jobs you are applying for. You will need to follow up on this matter right away as discrimination claims have a very short time-window in which such claim s may be brought (statute of limitations).

Regards,

Roger
