Legal Question in DUI Law in Pennsylvania

75 pa.C.S. §1543

Hi. In 2003 I was charged with D.U.I. I was only 17. In 2004 I was charged with Under age alcohol offense. I was recently pulled over. I have been charged with a 1543(b) driving while my lisence is suspended, dui related. My 6308 (underage alcohol offense) suspension started in june 05 ended june 07. Yet they say Im still on a DUI suspension. How do they figure? If my DUI suspension ended in 05 then how am I still on a DUI suspension? I printed my 10 year driving history report which stated my current suspension was underage alcohol offense. So?

Please, any advise is greatly appriciated.

There must be something on your record that is unresolved. Go to a AAA office or PEnn DOT messenger Service and resquest a Restoration Requirement Letter (RRL). Analyzing this will help you in your quest.

Remember one thing, Penn DOT only give accurate advice about 40% of the time. And of that 40% none of it is ever in your best interest. I restore licenses everyday. Please call once you have these documents, and I would be happy to discuss you options.

You should know that the law is clear. Once you are DUI suspended, you stay DUI suspended until you have restored. The Superior Court observes this crazy interpretation of a 1 year term suspension for DUI. The Commonwealth Court does not.

Lastly, you need to plead not guilty to the offense and request a court date.
