Legal Question in DUI Law in Pennsylvania

under age dui in pa

My 17 yr old son was in a car accident. He totaled his car plus 2 others, both parked. His blood alchohol level was .17 how long will he lose his licence? Also he is not a PA resident will that change his punishment in any way?

If he totaled his car and two others it is likely that physical injury was involved. In most counties I believe that the District Attorney's offices have policies that preclude A.R.D. under such circumstances. Residing out of state will not affect his sentence but the fact that he was under 18 years old may.

Your son really needs an attorney. If he can't afford one, he should talk to the Office of the County Public Defender where the accident occurred as soon as possible but in any event before the Preliminary Hearing.

If he is accepted into ARD he faces a two month suspension for the DUi itself. He needs to speak with an attorney. I offer free initial consultations.

I really, really recommend that you talk to a private attorney as soon as possible. Best case scenario is ARD, which is a kind of probation for first time offenders. However, a D.A. has complete discretion in deciding to grant A.R.D., and the facts here might lead a D.A. to deny it. Feel free to call our offices.
