If he totaled his car and two others it is likely that physical injury was involved. In most counties I believe that the District Attorney's offices have policies that preclude A.R.D. under such circumstances. Residing out of state will not affect his sentence but the fact that he was under 18 years old may.

Your son really needs an attorney. If he can't afford one, he should talk to the Office of the County Public Defender where the accident occurred as soon as possible but in any event before the Preliminary Hearing.

I really, really recommend that you talk to a private attorney as soon as possible. Best case scenario is ARD, which is a kind of probation for first time offenders.
