Legal Question in DUI Law in Pennsylvania

my daughter was arrested for underage drinking but she did not have any thing to drink she was standing beside people that was drinking that she did not even know at a consert but she passed a breathalizer how can they charge her with anything? she was at a consert that security dose the parking she did not choose her parking spot. please help!!!!

Write to the prosecutor, and explain. If he refuses to drop the charges, demand discovery (in writing!) of all notes, test results, etc., then go to court and explain. The police need to prove beyond a reasonable doubt that she was guilty, and if there was a breathalyzer, she should be able to prove she was not drinking. Good luck.
