ARD and driving record

The DUI occurred in Chester County. The test results from the PSP crime lab showed my BAC to be 0.09%. This is my only DUI offense, so I am assuming that I will not receive a license suspension. What will insurance companies be able to see on my driving record? I read somewhere that nothing will show on my driver history because there is no DUI conviction and no sanction was imposed. Is this true?

The combination of first offense and BAC level is what gets you no license suspension for an ARD disposition. Your .09 falls in that category. You should have an attorney to ensure your rights. I offer free consultations.

The short answer is yes because there is no conviction on the driving record. However there is a record of the ARD admission for the purposes of counting a 2nd offense. As far as I know, there is no public access to this record.

In addition to what has already been said, it is possible that there is a conversion factor on the blood test that could take your blood alcohol level below .08 depending on the test methodology. You should talk to an attorney as soon as possible.
