ARD program and visa to the US

Hello, I am russian student. In 2007 I

studied in the university in

Pennsylvania and I was pulled over

when I was drunk. I successfully

completed ARD program and came

back to Russia. My attorney told me

that the record of arrest would go out.

But I read that the record of arrest is

usually transmitted to nine or ten local

and state agencies.

My question is: when I go to get a visa

to the United States what should I

answer to the question ''have you ever

been arrested?''. I am afraid that the

record of my arrest is somewhere in

one of that agencies which contact

with organization which gives visa to

Russian citiezens.

I just read the other attorney response and I must sya that I disagree with his assessment that you can say you were "never arrested"...the right answer is you were NEVER CONVICTED. I am an attorney that practices in Philadelphia County, and have helped people with criminal and immigration questions for more than 17 years.

You should make a formal expungement petition to clean out the case history from all reporting agencies. I can help...

You should be safe to say you have not been arrested. They are concerned about criminal activity, and at worst, DUI is quasi-criminal, and after ARD, the arrest should not count at all.
