Legal Question in DUI Law in Pennsylvania
I was arrested for D.U.I. last night after taking a field sobriety test and failing the PBT. I was then taken to the hospital for blood work then to the local prison to be fingerprinted and photographed. I received a phone call today saying that my blood test came back .122 and I will be receiving charges in the mail. I was never read my Miranda rights and I was wondering if this was correct when I was in fact taken into police custody.

No. Police don't have to read you miranda warnings if they are not interrogating you. They didn't need to--your BAC test gave them all the information they ever wanted. You may be able to fight it on other grounds. Give our offices a call. 267.639.3105.
