Legal Question in DUI Law in Pennsylvania

I was arrested for suspicion of dui after swerving on a country road around midnight. Had 2 drinks over a 3 hour dinner and had left the restaurant 1 hour before that. They didn't impound my car, just parked it in a parking lot. /i blew in breathalyzer only 2 times, no reading, so they said that I had refused and would lose my license. I was very upset and offered to do a blood test but they said no. I wasn't charged, left with my keys and car, and license and they said I would get papers in the mail. They next day, there was a note on my windshield of my car in the parking lot from the policemen saying that he had left his flashlight in my car and wanted me to bring it back to him at the police station as soon as I removed my car from the lot. I went immediately to an attorney and she advised me to hold onto the note and flashlight. She called the policeman and left a message asking if he was going to charge me and also that I had the flashlight but lived too far away (1 hour) to drive it there. He never responded. 17 days have passed and there has been nothing filed and now my attorney is not sure what they are doing. Do you think they have evidence to file? I didn't blow the breathalyzer at the scene either, but asked to call an attorney.

You definitely need representation....there are many issues that you have to face....somethings just do not sound right....

You can lose your license for a year for a refusal if it is written up that way....but you do have rights of appeal...even if you are found not guilty of the DUI itself...
