Legal Question in DUI Law in Pennsylvania

I was in a auto accident. My car totaled. No other damage or injuries. Several hours before the accident I took an accidental dosage of regularly prescribed medications. I also have bona fide diagnoses of Bipolar Disorder and (combat related) Post Traumatic Stress Disorder ongoning. The air bag in my car deployed and rendered me in and out of consciousness for an undetermined time.

I was given a barrage of charges, including 4 DUI's.

I am attempting to propose an assertive defense of diminished capacity and/or accidental intoxication based on the medication mishap, the existing mental diseases and the mild traumatic brain injury from the air bag.

My accident occured in the state of Pennsylvania. Can you refer me to case law where such assertive defenses were upheld by the trial court or which were used to dismiss at the Preliminary Hearing?

First you need to take care of the DUI before you seek any claim for the motor vehicle accident. You should also talk to competent private counsel on the criminal charge. Feel free to call our offices. 267.639.3105
