what is the legal limit if you have a cdl but are driving your own vehicle and it is not a commercial vehicle?

The legal limit for operating a vehicle other than a commercial vehicle or a school bus is .08%. As the holder of a CDL the legal limit is .o4% within 2 hours of having operated a commercial vehicle. The situation arises where after having driven a commercial vehicle, parking it, having a few drinks, being pulled over, your blood alcohol level could be between the two figures and if the test is conducted within two hours of you having operated the commercial vehicle it would be a violation of the law.
