Can I be Charged with a DUI?

I was arrested almost 2 years ago for simple possession of marijuana and two counts of paraphernalia. I was also charged with a DUI despite the fact that I was not under any influence. I was taken to the county DUI processing center for night arraignment. There I was filmed doing a field sobriety test and a blood sample was taken. I had not smoked marijuana that night but had in the recent past so the blood test would be positive. Can I be Charged with a DUI?

you can be charged with anything. the real question is whether there will be a successful prosecution against you? if a complaint was filed against you, they only have a about a year to prosecute you. however, if a complaint was never filed they may have more time. as to the statute of limitations, the answer is a long one.
