Legal Question in DUI Law in Pennsylvania

I am completing my final year in nursing school. I unfortunately made a stupid decision and drove under the influence resulting in a 3rd teir DUI. I've never been convicted of anything else so I am eligible for ARD (crossing my fingers I am given the option) Will this effect me going for my license come May or June?

1 Answer from Attorneys

ARD is a program for first time offenders that is at the discretion of the District Attorney's office. Each office follows a similar set of rules but some have little nuances depending on the specific county. Based on the information you provided, it appears that you are a good ARD candidate. However, it would be best to hire an attorney to review the facts of your case before any decision could be made on that regard. Even with that attorneys review, it is still up to the DA's office. But DUI first time offenders, without more information, are generally accepted.

As for your nursing license, that depends on the nursing board and I cannot answer that. What I can say is that ARD does not result in a conviction and is an adjudication (which are legally different). Upon successful completion of ARD, you can have your recorded expunged.

Please let me know if you have any further questions.
