There are a couple of kinds of DUI charges with respect to a CDL. If you were operating a commercial vehicle it is a lot different than if your first offense was on the weekend while you were off. The penalties are also different depending on the level of alcohol in your blood after you were driving. Also, if it was while you were driving a commercial vehicle, you're not eligible for an occupational limited license while you may be if it was while you were driving your own vehicle. This is a complicated area and you really need an attorney, especially if you are eligible for an occupational limited license.
Re: D u i
You will likely get ARD for the DUI, which involves a license suspension of up to 90 days. Your CDL, however, will be suspended for a year.
Therefore, if you have any defense to the case, it's important that you defend it rather than taking the ARD, although you put at risk a possible jail sentence and a license suspension of your regular license of up to a year as well.
If you wish to provide me with more information about the specifics of your case, please email me--and please let me know what it is that you drive for your job (what type of vehicle) that requires a CDL.
Thanks.
