Drinking Citation

If i take a class for my first time offense

will the citation be off of my permanent

record? Also, if i plea not guilty and

found guilty, do i face the same

consequences as pleading guilty? I am

If you are on track for an ARD or section 17, then the dui would not appear on your record unless you were convicted of another dui within 10 years of the first one. If you are found guilty it would be the same as pleading guilty. There are a number of factors for ARD(valid license, insurance and registration at the time of the stop), no accident, no leaving the scene, no property damage. You will definitely want to consult an attorney to see if you are eligible for ARD.

Generally the MDJs are pretty good with these. You're probably looking at some community service and a fine. In the cases that I've had at the MDJ level, there's usually no defense. If the cop says he smelled alcohol on your breath, that's enough. There is no adjudication of the charges if the MDJ puts you into a diversionary program so it's not on your permanent record.
