Legal Question in DUI Law in Pennsylvania

DUI in an adjoining property next to bar:

I recently got cited for my second DUI with ten years (by two weeks). I left the bar to go home, and I was parked in an adjoining property next to the bar for overflow traffic (does not belong to the bar). When I backed out, my car slid on the ice and got wedged between two cars, no damage done, but I was stuck because of the grade of the lot, and the ice. The police came and cited me for DUI. Because of the icy conditions they immediately took me to the hospital to get a BAC, but no other test was offered. The owners of the lot I parked in said they didn't mind the people of the bar allowed they overflow to go there, because it would be afterhours for their business. My lawyer said I don't have a leg to stand on, but I would like to have a second opinion.

That's a tough case. Off hand I don't see any defenses either and I'd probably go along with your attorney's opinion. Unless there's something else to explore I'd probably just try to negotiate some type of house arrest or alternative housing with the Office of the D.A. in your County.
