Legal Question in DUI Law in Pennsylvania

Hello, I was given 2 breathalizer tests on site and then then had a blood test done in hospital. I am awaiting the results, this just happend 1/16/08 in Yardley PA. I was stoped for speeding and this did not involve any other vehicles Also I had 1 DUI in 1989 and did not have ARD I served 2 days in jail and lost license for 1 year. I am self employeed and travel quite often to manage accounts. What type of charges am facing and what steps should I take now to have the best outcome. Thank you

A lot depends on the policy of the D.A. in the County where you were arrested. In some counties, you may be eligible for ARD. Since 2003 the penalties depend upon the BAC. This would be a first offense regardless of the D.A.s policies since the last one was more than 10 years ago and the only question is whether ARD would be available. An occupational limited license might be difficult because of your self-employed status.
Anyway, you should retain an attorney for specific answers especially if your livelihood depends upon the occupational limited license.
