Legal Question in DUI Law in Pennsylvania

My brother was crossing Roosevelt Blvd. and was struck and killed by a woman who was high on cocaine. We are being told that she is only being charged with dui. Is this possible? Shouldn't she atleast be charged with vehicular homicide? I am just stunned!

She should absolutely be charged with vehicular homicide! This makes no sense at all. Have you spoken to anyone at the DA's office? I'd be happy to make a call on your behalf.
Until the matter goes to trial, the government can always move to amend the charges for homicide and aggravated assault and other appropriate charges.
I realize that this is the furthest thing from your mind, but you should sue the pants off of this woman and anyone that served her alcohol.

First, the DA will probably amend charges. If you call my office, I will look the defendant up on the docket for you and tell you what she is being charged with. Second, you should also preserve your family's rights to recover on the civil side. Give our offices a call to discuss.

My sincere condolences to you and your family. Something does not ring true here. I would certainly speak with the District Attorney's office to find out exactly what the woman is being charged.
