Legal Question in DUI Law in Pennsylvania

DUI (foreign visitor)

Hello. I'm an exchange student from Ukraine. I was stopped by police when I was drunk. I had rate of alcohol less than 0.16%, it is my first offence and where was no accident, so I can be eligible for ARD program. Later I received a letter, where was written that i'll have Preliminary Hearing at 12/12/07, where my bail will be set. In December 17 I'm going to fly to my country. I have already bought the ticket to fly. So I have a few questions:

1) Is it possible to fly to Ukraine and return before I'll get Formal Agreement. Should I have any problems with this?

2) how much can be amount of bail in my case?

3) is it possible that my case will not be eligible for ARD?

I have limited experience with this but recall an instance of a foreign national getting ARD. Bail may be a problem. It may be possible to waive the Preliminary Hearing and enter a plea on the same date. You should contact an attorney who practices in the County in which you were stopped. Some counties have an expedited process which would seem to be in your best interest.
