The police officer who charged my husband with a DUI never showed up at magistrate-case was dismissed-now he refiled-is this right?

When a case is dismissed at the district judge (magistrate) level, the police may refile the charges. However, they have to get written sign-off from the DA. If this was't done, you should get an attorney who will be able to challenge this at the right time, so as not to cause it to be refiled again--but correctly.
