Legal Question in DUI Law in Pennsylvania

Can't Someone Help Us?

I need to find an attorney who is licensed in both NC and PA. I have tried to find an attorney to help us but no one ever responds. My son has an outstanding DUI arrest while visiting PA. He lived in FL at the time. To confuse matters even more, he has relocated to NC. We just want to get this all behind us.. Can ANYONE help?

Your son needs a PA attorney to resolve the charges there. If he does not he is liable to be convicted in abstenia and will become a fugative.

I'll be glad to help. I work with these cases every day, though I am only licensed in NC. You need someone who understands the National MVR, and I do.

Re: Can't Someone Help Us?

Actually, it's simpler than you may believe. It makes very little difference that your son is living in NC and was living in Florida when he got his DUI. What needs to happen is simply to deal with the charges in Pennsylvania. After the disposition of the DUI case in PA, there will be an issue regarding the mandatory license suspension which comes along with DUI cases (assuming that he can't beat the DUI case, of course), and that will be dealt with via reciprocity between NC and PA.

The first step, however, is to deal with the criminal charges in PA. If he is out of the jurisdiction and has missed any hearings, there will be a warrant for him and that needs to be cleared as the first order of business. After that, we can take a look at the DUI itself to determine the veracity of the case.

Please feel free to contact me with any further questions which you may have.

Sincerely,

Marc D. Daffner, Esq.
