Legal Question in DUI Law in Pennsylvania
My husband was charged with a DUI and they are offering him a plea of 3-6 months. This is his second DUI, he had one in 2003, his alcohol level was 0.150 this time. When we received all the paperwork concerning the night of the incident, we discovered that the vehicle description is grossly wrong. The make and model of the vehicle is wrong, the registration number that they have down belongs to a completely different person per the DOT. My husband wants to know if he can have this thrown out based on a technicallty based on the wrong vehcile information in the police report and the court documents.
