Legal Question in DUI Law in Pennsylvania

Incorrect dui charge

I was arrested for DUI near Harrisburg, PA. My notice of Preliminary Hearing lists the charges of 3802A1 and 3802B. 3802B is a charge for driving with BAC .1-.16%. My breathalizer result, however, was a .085%. Is this a mistake, and can I use this to my advantage? it states in the affidavit what my BAC was.

Re: Incorrect dui charge

It should be corrected at the preliminary hearing. Make sure your attorney (yes you should get one) knows this and gets the charge corrected.
