Legal Question in DUI Law in Pennsylvania

misspell of name on summons

If your name is misspelled on a summons can the case be dismissed even though you pleaded guilty at the magistrates office and sent it downtown? thanks

If the offense was a summary offense and you pled guilty your only recourse is to file a summary appeal to the Court of Common Pleas. Prior to doing that you should speak with an attorney to discuss whether the technical error your aware of would provide you with a defense or leverage to negotiate a plea bargain. The appeal period is 30 days. If it was a misdemeanor you have 10 days to change your plea to not guilty by notifying the Magistrate in writing. I offer free consultations.

No, a simple misspelling would be insufficient to merit an appeal.
