Legal Question in DUI Law in Pennsylvania

mistake on charges filed

I was recently pulled over for a DUI because I forgot to turn on my headlights. The officer who filed my papers charged me for driving a school bus while intoxicated and did not charge me with careless driving. If there is a mistake on the charges filed, does that mean that I can't get charged? I was not driving a school bus.

Re: mistake on charges filed

It's definitely possible. I have been successful having charges similar to this dismissed in the PA courts. Feel free to call our offices for a free consultation. Still, even if they are permitted to amend, you will need to defend the charges.
