Legal Question in DUI Law in Pennsylvania
First offense
After leaving a bar/restaurant, I backed into a car apparently causing a little damage to the vehicle's front bumper. I continued to drive away. Later I hit a metal pole in a different county causing only a little damage. I proceeded to drive home. Police came to my house. They gave me a breathalizer resulting in BAC of .16. They arrested me and took me to a hospital where I gave two samples of blood. I do not know the results of the blood work. I want to know what I can expect from all of this. Before this I had a clean, perfect driving record. I am a single mother and I must be able to continue to work. Please tell me what the laws are and what I can expect to happen to me. Thank you.

Re: First offense
Worst possible scenario is a DUI conviction, and leaving the scene of an accident (2 cts.). However, there are many possible defenses depending on the specific facts of your case. In addition, ARD will minimize the duration of any license suspension, etc. However, given the fact that you left scene of accidents, the DA may not wish to offer you ARD.

You need to speak with a lawyer right away. The new DUI law has a number of technical defenses. If you don't have a good defnse a lawyer can help you apply and get ARD. ARD allows you to avoid jail time and reduces license suspensions. I offer free consultations.
