Legal Question in DUI Law in Pennsylvania

first offense

I was recently arrested for a DUI, first offense, in Pennsylvania. Prior to the arrest, I submitted to a PBT which returned a result of 0.10. I was then taken to a hospital where I gave four blood samples (I do not know the results yet). What are the likely consequences? Should I retain a lawyer? Any help is appreciated.

Procedures and requirements vary from county to

county. In most cases you will need a lawyer to

waive (not have) the preliminary hearing and concurrently apply for the ARD program. ARD is

a pretrial disposition that allows you resolve a first offence (DUI or otherwise) without going to

trial and having a conviction. You will also avoid a one year license suspension, although you may lose your license for a month or two. In any case, an attorney can help you avoid mistakes and get you through the process as painlessly as

possible. ARD involves paying "costs" to the court etc. between $500 and $1,200. An attorney will run you between $800 and $1,500. If your case is in Chester, Montgomery or Delaware Counties, I can help you. Call for more information. William L. McLaughlin, Esq.

Re: first offense

Everyone charged with a criminal defense needs representation. If there is no other offense, you should be eligible for the ARD program. If you keep out of trouble for a year the charges are dropped and the arrest is expunged. I offer free consultations.

In what county did it happen? If in Delaware Co. you must have an attorney in order to get ARD. In other counties you can apply for it yourself. When is your hearing scheduled? Feel free to contact us for free consultation and affordable services.
